These Terms of Service (“Terms”) govern your access to and use of the Econic Platform (“Service”) operated by Datakey Pty Ltd (ABN 75 658 224 376) trading as econic.ai (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Account Registration

To use the Service, you must create an account using Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: use the Service in any way that violates applicable laws or regulations; attempt to gain unauthorised access to any part of the Service or its systems; interfere with or disrupt the integrity or performance of the Service; use the Service to transmit harmful code or malware; or use the Service to infringe upon the rights of others.

4. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Datakey Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit to the Service, but grant us a licence to use, store, and display such content as necessary to provide the Service.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://econic.ai/privacy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the maximum extent permitted by law, Datakey Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us at support@econic.ai.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
